Facts
On Jan. 24, 2013, plaintiff, 57, was struck by a vehicle driven by defendant while she was walking in an unmarked crosswalk at the intersection of Hollywood Blvd. and North Harvard Blvd., in Los Angeles.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant should have seen her in the middle of the street and avoided striking her. Plaintiff claimed that defendant negligently operated her vehicle. Plaintiff claimed she sustained injuries to her feet.
DEFENDANT'S CONTENTIONS:
Defendant contended that plaintiff was not walking in a designated crosswalk at the time of the collision. Additionally, she contested plaintiff's injuries, arguing that plaintiff had a pre-existing condition.
Injuries
Plaintiff suffered a fracture to her right ankle, requiring several surgeries and physical therapy. She also sustained a laceration to her left eye and bruise to her left shoulder.
Result
The parties settled for policy limits of $1.25 million.
