Facts

On March 31, 1994, the plaintiff, a 34-year-old billboard painter, was stopped in his vehicle behind the defendant's stakebed truck at a red light headed westbound on East Grand Boulevard. The plaintiff alleged that the defendant suddenly put his truck in reverse and crashed into the plaintiff's pickup truck. The front of the plaintiff's pickup went under the hydraulic lift at the rear of the defendant's truck. The plaintiff brought this action against the defendant driver based on negligence theories of recovery.

Settlement Discussions

The plaintiff made a $220,000 settlement demand. The defendant made a C.C.P. º998 offer of compromise for $30,000.
