Facts
On May 2, 1990, the plaintiff, Irene Fures, a 32-year-old domestic worker, was a middle seat passenger in the front seat of a truck traveling southbound on the 5 Freeway. A truck operated by the defendant, William Fedak, rear ended the vehicle in which the plaintiff was a passenger. The plaintiff alleged that her head hit the window behind her and that she lost conciousness for 10 seconds. The plaintiff brought this action against the defendant driver and the defendant, Tailored Masonry of California, defendant's employer, based on negligence theories of recovery.
