Facts

During the El Nino storms in 1998, highway 166 washed out in the middle of the night. The plaintiff drove into
the Cayuma River. Three others died in the washout including two California Highway Patrol officers. The
plaintiff was one of two survivors.

Settlement Discussions

The plaintiff demanded $1 million, increased to $1.2 million. The defendants made no offer until 12 days before trial.
