Michael Silverstein approached Net-Present.com Inc. dba Zeocast.com (Net-Present)about partnering with Bolt Inc. to expand the reach of Bolt.com's website. Net-Present agreed to assign its internet traffic and help Bolt promote pop artist Ciara on its website. Bolt agreed to be the exclusive seller of inventory sold in conjunction with "Youth Zeoflicks" and place advertisements in the movies created by Bolt or affiliated with Net-Present. Net-Present would receive a percentage of advertising revenues generated by Youth Zeoflicks. Net-Present sued Bolt, alleging Bolt breached its contract to sell half its advertising inventory and share in the profits.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended the defendant failed to help it integrate plaintiff's technology and ultimately stopped all efforts at integration because it believed the product would compete with defendant's photo tool.
DEFENDANT'S CONTENTIONS:
The defendant denied the allegations.
Damages
$1.6 million lost advertising revenue and $7.2 million lost business revenue.
