Facts

The plaintiff was a security agent at Peninsula Beverly Hills Hotel. The defendant reported to hotel management
that the plaintiff did not afford the defendant and his wife privacy while they used the hotel's swimming pool
after hours with hotel's permission, but instead hovered over the defendant's wife.
The defendant claimed that the plaintiff had a long history of misconduct on the job, and had been issued a
final warning that he would be summarily discharged if another event of job misconduct occurred. Two weeks
after the defendant's report, the plaintiff was terminated.
The plaintiff alleged slander per se, interference with prospective economic advantage, including breach of
contract, intentional infliction of emotional distress and sought compensatory and punitive damages.
