Facts
On Sept. 11, 1997, plaintiff, an off-duty seaman was at a nightclub in Santa Barbara to celebrate a friendÆs
birthday. While in the nightclub, plaintiff tried to initiate "your mama" type joking to a bouncer, who did not
find remarks about his mother humorous. The bouncer asked plaintiff to leave, who in turn called the manager,
who said plaintiff could stay.
After the manager left, the bouncer again asked plaintiff to leave, who refused, because the manager allowed
plaintiff to stay. The bouncer then called other bouncers over and physically ejected the plaintiff from the
premises. The plaintiff landed on a concrete sidewalk and felt a popping sensation in his knee.
The plaintiff had planned to become a civilian boat pilot upon discharge from the Coast Guard, but was
precluded from this career because of his knee injury. The plaintiff currently works at a golf course making $10
per hour.
