Facts

On May 7, 1998, the plaintiff, a real estate agent, was rear ended as she was slowing down
to make a right hand turn into a parking lot. Her car was propelled onto the curb after
being rear ended by the defendant.
The plaintiff's husband claimed for loss of consortium.

Settlement Discussions

Prior to filing of the lawsuit, plaintiff demanded $100,000 (policy limits). Defendant's first pre-litigation offer was $17,207.30, which was increased to $25,000.

Injuries
