Facts

On April 27, 2000, the plaintiff, a 44-year-old female dispatch clerk, was shopping in the Robinson-May
Department Store in Monterey Park in the shoe department. As the plaintiff was leaving, she slipped and fell.
Approximately 30 minutes later, she walked back to the area where she had fallen and saw a shoe on the floor.
She believed that the presence of the shoe on the floor caused her to slip and fall and thus suffer the injuries she
sustained.
