Facts

Katayoon Zandvakili, a 34-year-old writer, was driving her Volvo sedan on SR-89 near Truckee, when Charles Osborn's Mercury crossed over the center line and struck her near the front driver's side door. Zandvakili swerved off the highway and hit a guardrail. Osborn stated to a California Highway Patrol officer that he fell asleep at the wheel. Zandvakili sued Osborn, alleging vehicular negligence. The defendant admitted fault but disputed the nature and extent of Zandvakili's injuries and damages.
