The plaintiff, a mechanic, was driving through a picket line set up by the Northern California Carpenters Union. The plaintiff alleged that on June 17, 2003, he was defamed and personally attacked. The plaintiff claimed that he was punched by a field representative of the Carpenters Union on June 17, 2003 and this resulted in damages to his left ear.
