Facts

On June 30, 2003, the plaintiff was using the defendant's product. The top of the product had an aerosol type tip which struck the plaintiff's forearm. The contents of the product were released into the plaintiff's tissue as the tip of the product inserted into the plaintiff's arm. The plaintiff had surgery to remove the foreign body. The plaintiff argued that the product was manufactured improperly. The defendant's contentions were kept confidential at mediation when the case settled.
