Niesha Kinard, a nurse, sued her former employer Harbor-UCLA Medical Center, the County of Los Angeles and her former supervisors Kimberly McKenzie and Paula Siler alleging retaliation in violation of Cal. Health and Safety Code Section 1278.5 and several Labor Code sections.
Contentions
PLAINTIFF'S CONTENTIONS:
Kinard contended that she was retaliated against and eventually terminated after she complained about violation of nurse/patient ratios, patient safety and unsafe working conditions.
DEFENDANTS' CONTENTIONS:
Defendants contended that Kinard was terminated for her refusal to accept work assignments, and therefore, was terminated for legitimate, non-discriminatory reasons.
Result
The County of Los Angeles settled with Kinard for $850,000.
