Facts

Fireman's Fund Insurance Co. sued Alliance of Event Planners and Vendors Inc., Eva Royale, Gene Royale, Cesar E. Chavez Holiday Parade & Festival, and the City and County of San Francisco, involving an insurance dispute in connection with a horse riding accident by a parade participant on April 20, 2013.

Plaintiff issued a one-day insurance policy to cover the subject parade. An accident occurred involving a horse injuring a parade participant. The parade participant sued the city and the parade organizers. Plaintiff agreed to defend the city and the parade organizers, and settled with the parade participant for the policy limits of $1 million.

Contentions

PLAINTIFF'S CONTENTIONS:
PPlaintiff filed this lawsuit against the city and parade organizers, alleging it had no duty to defend or indemnify defendants under the policy and seeking reimbursement of the settlement and defense costs.

DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses. The city also cross-complained against another insurance carrier.

Result

The city agreed to pay $125,000 to settle the dispute.
