Facts
On August 29, 1986, Plaintiff Keith Anderson and Defendants Industrial Data Link (IDL) and Gilbert Vasquez, the sole owner of IDL, signed an employment letter whereby Vasquez allegedly promised Anderson stock in IDL as part of an executive salary package. In November 1986, Anderson began working for Defendants. IDL was moderately successful from 1986 to 1991 at which time Plaintiff allegedly demanded that IDL give him 9 percent of its stock. IDL and Vasquez allegedly refused to give Plaintiff stock. On January 31, 1991, Plaintiff quit and sued Defendants for business fraud and breach of contract.

Plaintiff contends that no demands or offers were exchanged prior to trial.
Damages
Plaintiff asked the jury to award $670,000 (the current market value of Anderson's 9 percent share of the stock) as well as $500,000 punitive damages against Vasquez and $500,000 punitive damages against IDL. Defendant contends that Plaintiff asked (in his complaint) for general damages in an amount exceeding $600,000 and punitive damages in an amount to be determined by the Court.

This was the second trial of the same case. The Court of Appeals reversed Defendants' nonsuit granted in the first trial.
