On Aug. 10 1999, the plaintiff and the defendant were in an automobile collision on I-10 shortly
after Hoover Street in Los Angeles, traveling eastbound in heavy traffic. The defendant was
directly behind the plaintiffÆs car when she averted her eyes from the road to look at two other
vehicles parked on the right shoulder, which had been involved in an earlier accident. The
defendant noticed that the plaintiff had slowed down but was unable to stop in time to avoid rear-
ending him.
