Facts
The plaintiff presented to the defendant's office in Yuba City for the extraction of two molars, specificlly numbers 14 and 30. The defendant oral surgeon recommended the extraction of three of the plaintiff's four wisdom teeth, including # 17. The plaintiff accepted this recommendation and all five teeth were extracted. The plaintiff subsequently complained of profound numbness on the left side of his mouth, including his cheek, gums, lip and tongue, which he associated with the extraction of # 17. Subsequent oral surgeons confirmed that the plaintiff had sustained injuries to his left lingual and left mandibular nerves.
Settlement Discussions
The plaintiff first demanded $290,000 and this was subsequently reduced to $90,000. The defendants submitted an offer pre-trial of $10,000.
Damages
The plaintiff claimed permanent injury to his left lingual and left mandibular nerves which caused a loss of taste, sensation and temperature on the left side of his mouth and tongue and a modest speech defect.
