Facts

On Saturday, July 21, 1990 the Plaintiff, a 44-year-old physician, presented to the Defendant, a general practitioner and surgeon, with complaints of upper back and neck discomfort. A chest X ray was obtained and found to be completely normal, in all respects. Physical examination elicited a "trigger point" which was, accordingly, treated with ultrasound, heat, and an injection of Xylocaine and Kenelog. Upon the administration of the injection the Plaintiff experienced an increase in pain and the onset of respiratory difficulties, which progressively worsened. The following day the patient was taken to the emergency room at which time another chest X ray demonstrated the patient to be suffering from a large pneumothorax (i.e., a 70% collapse of her right lung).

Settlement Discussions

Defendant contends they made no offers (no consent) and Plaintiff demanded $30,000.
