Facts
Plaintiff purchased a commercial building in Compton from Defendant. Escrow opened in February, 1988, and closed in June, 1988. The purchase price was $1,135,000. Plaintiff purchaser made a cash down payment of $400,000. Defendant seller also received a trust deed. Several years later Plaintiff became delinquent in her mortgage payments to Defendant, who initiated a succesful foreclosure action and eventually recovered ownership of the property.

Defendant contends that prior to the commencement of trial, Plaintiff made a settlement demand of $600,000, Defendant countered at $25,000.
