Facts

On April 10, 1989, Plaintiff, a 57-year-old self employed trucker stopped in his tractor-trailer rig at a traffic light, waiting to enter the freeway in the City of Arcadia. He was hauling a full load of dirt and debris. Without warning, his truck was rear-ended by a dump truck owned by the City of Sierra Madre and driven by its employee. The driver of the dump truck claimed that his brakes had suddenly failed without warning.
