On October 18, 1990, at approximately 5:45-6:00 a.m., Plaintiff Irma Garcia, a 26-year-old train reservation clerk, was driving her pick-up truck on the feeder road from the southbound Hollywood Freeway onto the southbound Harbor Freeway in downtown Los Angeles. Defendant driver William Waller was driving a ten-wheel cab-over trash-bin roll-off truck owned by Defendant Big Disposal Company. Waller was on the feeder road from northbound Hollywood Freeway onto the southbound Harbor Freeway. Plaintiff was travelling 35-40 mph in the number one lane of her respective on-ramp, saw the Defendant truck, and "felt she had enough room to merge," stating that she thought the Defendant truck had yielded to her. Defendant driver was travelling 25-30 mph in the number two lane of his respective on-ramp. An impact occurred between the right from corner of the Defendant vehicle and the left rear corner of the Plaintiff's vehicle. The impact caused Plaintiff's pick up to spin out of control and ultimately come to rest against the center barrier wall on the southbound side of the Harbor Freeway.
