On August 13, 1991, Plaintiff was a 35-year-old welder residing in Gulfport, Mississippi and working in Martinez, California (during a plant shutdown in Gulfport). After his workday ended, he was walking through his employer's company premises when Defendant's employee driving a van, drove past the Plaintiff, striking Plaintiff on the shoulder, upper back, and hip with the fender van mirror. The driver and his passenger had been arguing, were ordered to leave the premises by their supervisor, and were still involved in an argument as they drove past the Plaintiff, allegedly traveling at a high rate of speed. The van driver did not see the Plaintiff because his vision was obstructed by blood resulting from his passenger' blow to the driver's face.
