Facts

In 1976 a physician on Defendant HMO staff, told Plaintiff that a 33-year-old homemaker, that she had cancer and performed bilateral subcutaneous mastectomies. Ten years later, Plaintiff found out she did not have cancer and operation not necessary.

Settlement Discussions

Plaintiff contends they made a 998 demand of $250,000 and Defendant offered $100,000 at the voluntary settlement conference.
