Facts
On February 22, 1990 the decedent, 28-year-old Davis Shoulders, was seen in the emergency room of Methodist Hospital with complaints of chest and left arm pain. In the course of a workup it was discerned that the patient was anemic; thus, the Defendant, a board certified internist, was called. The patient was admitted to the hospital for purposes of a diagnostic workup; however, the following day, after the initial study did not reveal the etiology of the problem, the patient was discharged with instructions to have the workup completed on an out-patient basis. Approximately 3 hours following discharge, the patient was found at home in cardiac arrest and was unable to be resuscitated.
Settlement Discussions
Defendants contend they made no offers (no consent) and Plaintiffs demanded $50,000 at the last mandatory settlement conference.
Damages
Burial and funeral expenses - approximately $6,000. All other expenses were discharged in bankruptcy; thus, not in evidence.
