The decedent, 39-year-old Enrique Torres, first consulted with the defendant Matthew Selmon, M.D., a cardiologist, in July, 1993. He had a total occlusion in the left anterior descending coronary artery. The defendant Selmon performed an arthrectomy, opening the left descending anterior coronary artery. The defendant saw the patient on a few occasions over the following years and when he saw the patient on Aug. 18, 1999, the patient complained of chest pain. Two resting EKGs were abnormal and a stress echocardiogram was positive. The next day, the patient suffered a heart attack and died.

The decedent suffered a small heart attack in the early morning hours of Aug. 19, 1999. He suffered a larger heart attack later that morning. The first was due to the rupture of a vulnerable plaque in the circumflex artery. The other was due to the rupture of a vulnerable plaque in the left anterior descending artery.
