The plaintiff, a 58-year-old salesman, was in the course of driving his Toyota MR2 when he was rear-ended by the defendant who was within the course and scope of his employment with the defendant O.O.C. Inc. The defendants admitted liability but argued that the impact was minor and could not have caused the claimed injuries.
