The plaintiff, a 58-year-old electronic assembler, was a back seat passenger in a car driven by Patricia Harding. As they were driving in Los Angeles County, they were involved in an automobile accident with Edward Jenkins and the defendant Valencia. The plaintiff sued Harding, Jenkins and Valencia. The defendant admitted that he skidded and crashed into the rear of the Harding vehicle but contended that the impact was insufficient to have caused the plaintiff's injuries.
