Facts

The plaintiff was a tenant at the defendant's apartment building when he tripped and fell on a wheel stop in the courtyard of the building at night. The plaintiff sustained a right patella fracture that required two surgeries. The plaintiff alleged that the wheel stops and the lack of lighting in the courtyard constituted dangerous conditions.

Settlement Discussions

A mediation before Peter Searle was held but was unsuccessful. The case finally settled for $150,000.
