On June 2, 2001, the plaintiff W, a 56-year-old handyman/wood carver, and the plaintiff S, a 41-year-old bookkeeper, were traveling westbound on Highway 580 in Alameda County. The defendant B, was driving a Honda which was owned by the co-defendant, his father. The defendant B was driving at a high speed and lost control on Highway 580 near the Center Street overcrossing. He struck the plaintiffs' vehicle on the right rear, causing it to lose control and strike another vehicle, then the median barrier and then overturn.
Settlement Discussions
After two mediations, the plaintiffs settled their claims for $1,250,000.
Injuries
The plaintiff S sustained degloving injuries to her legs and feet and suffered bilateral ankle injuries as well as artery and tendon injuries. All these injuries required surgery, including the removal of a piece of glass from her left elbow. The plaintiff W sustained a mild closed head injury, fractured nose, multiple face lacerations, head laceration, knee laceration and other soft tissue injuries. He also sustained a further subsequent injury to his hands due to inattentiveness caused by the closed head injury.
