Facts
In August 2001, plaintiff Paramount Unified School District brought an eminent domain action regarding the condemnation of land owned by defendant John Priem for construction of a new elementary school in the city of Paramount. The parties disputed the amount of just compensation for the property being condemned and the defendants' entitlement severance damages for the remainder of the property owned by the defendant.
Damages
John Ellis, real estate appraiser for the plaintiff, appraised the condemned property's value at $767,000. The defendant's appraiser, Michael Waldron, opined to total compensation of $1,010,000 which included the value of the condemned property at $866,000 and severance damages in the amount of $144,000 for the decrease in the value of his adjoining property.
Other Information
The plaintiff's motion in limine to exclude the defendant's severance damage claim was granted by the court, eliminating the severance damage claim. The parties reached a settlement on the amount of compensation for the condemned property on the third day of trial.
