On Nov. 17, 1991, the plaintiff, Nuhad Mubarkeh, a 19-year-old student, was operating a vehicle southbound on Desoto when she attempted to make a left-hand turn onto Sherman Way. A vehicle operated by the defendant driver, Steve Vinitsky, and owned by defendant Vin-Gram, Inc., dba Budget Rent-A-Car, struck the vehicle operated by plaintiff Mubarkeh. Two additional plaintiffs, 20 and 21-year-old students, were passengers in the plaintiff's vehicle. The plaintiffs brought this action against the defendants based on negligence theories of recovery.

Injuries

The plaintiffs alleged that they sustained neck and back injuries requiring chiropractice care. The plaintiffs claimed neurological evaluation was required, as well as MRI evaluation and that surgery was recommended for all three plaintiffs.

The verdict was reached approximately four years and seven months after the case was filed. ARBITRATION: An arbitration was held on May 25, 1995, before Jack Mattingly resulting in plaintiff awards of $10,675, $13,993 and $14,771. The defendants requested a trial de novo.
