Facts

On June 3, 2004, plaintiff Amber Hyde, a 12-year-old student at defendant First Church of God Christian School, allegedly opened a metal file cabinet to help her teacher distribute books to the class. The file cabinet drawer failed to safely stop, subsequently falling out of the cabinet and onto plaintiff's right leg.

Plaintiff alleged premises liability.

Injuries

Leg laceration, scar and potential scar revision surgery.

Result

The parties settled for $109,808 including medical expenses of $2,265, attorney fees of $27,450 and costs of $1,660.
