Facts
On May 14, 2001, plaintiff Zachery Duff was arrested in San Francisco by defendants police officers Turkington, Abramson Lee, Lopez, Briggs, Berry, Fruchenincht, Guardado, Zak, Freeman, Najarro and Crujallo. Plaintiff alleged that defendants injured him during the course of the arrest, and that defendants discriminated against him because he was African-American. Plaintiff also alleged false arrest, assault, battery, and intentional and negligent infliction of emotional distress.
Defendant city and county of San Francisco (erroneously sued as San Francisco Police Department) denied plaintiff's allegations.
Injuries
Plaintiff claimed pain and injuries to his elbow, back, left arm, hand, shoulders, lower back as well as emotional distress.
Result
Defense verdict. $9,071 in costs awarded to defendant.
