Facts

Plaintiff Gabriel Nnoruka used the services of defendants Immediate Funding and Immediate Escrow to procure a second home mortgage. Defendant Laurie Allread performed notarial duties regarding the mortgage documents. The plaintiff sought to cancel the transaction and sued the defendants, alleging negligence, violation of notarial duties and cancellation of written instruments. The defendants filed a cross-complaint against plaintiff, alleging breach of contract.

Damages

The plaintiff claimed damages due to his inability to refinance the loans on his home. On the cross-complaint, defendant Immediate Funding claimed damages for the value of the contract, which was $23,000.

Result

After a three-day bench trial, the judge ruled in favor of the defendants after finding negligence but no damages. On the cross-complaint, the judge found in favor of plaintiff.
