Contentions
PLAINTIFF'S CONTENTIONS:
Haraway was the creator and copyright holder of the title "Opening Act," for use as a title for a talent-based television program. Haraway registered the title in 2003 as part of a series of reality TV shows. Haraway claimed that an employee of International Creative Management executed a release agreement that plaintiff presented her on May 27, 2004. Plaintiff claimed that the agreement held that ICM would not use plaintiff's copyrighted works without entering an agreement with plaintiff's company, and that ICM would not present his works without acknowledging that plaintiff owned them.
