ACCORDING TO THE DEFENDANT/CROSS-COMPLAINANT: defendant/cross-complainant single woman
Carrye Goins and plaintiff/cross-defendant married man Eric Herrera were co-workers at PacifiCare Health
Systems Inc. They had engaged in a sexual affair over an eight month period.
As a result of events transpiring during the relationship, and afterwards, Herrera reported to PacificCare that
Goins harassed and stalked him and was delusional.
The plaintiff/cross-defendant denied the affair and stated that it was a figment of Goins'
imagination.
Settlement Discussions
At a settlement conference, the defendant/cross-complainant contended that she demanded only an apology to be noted on the record, without any monetary compensation, and an admission by the defendant of the affair. According to the plaintiff, he later agreed on a settlement of $20,000 plus admissions, which was withdrawn when Goins refused to agree to a confidential program with liquidated damaged. According to the defendant, this never happened.

According to plaintiff/cross-defendant: After receiving a pre-litigation letter from Goins' attorney, Herrera and his wife initially filed a complaint against cross-complainant for intentional and negligent infliction of emotional distress, interference with the marital contract, stalking, invasion of privacy, and sexual harassment, which they voluntary dismissed months before trial. The complaint also alleged sexual harassment against the employer, PacifiCare Health Systems Inc. Judge Thrasher granted PacifiCare's demurrer without leave to amend.
