The defendant physician placed a UroLume stent on the plaintiff in order to control urinary retention problems.
The plaintiff remained unable to void and claimed excruciating pain necessitating multiple emergency room
visits, catheterization procedures and, ultimately, the removal of the stent, followed by a TURP.
The plaintiff and his daughters claimed that no consent was obtained for the placement of this "experimental"
device and no choice was given for any more conservative methods of treatment such as observation or
medication.
The plaintiff claimed he would have opted for a TURP, if surgery was his only choice,
and not the stent.
