Facts

On May 30, 1999, the plaintiff, a 38-year-old male, was driving his Ford Festiva westbound on the I-10 Freeway
near Banning. The plaintiff's left hand was outside his window, holding onto the roof while he was driving.
Without warning, a truck wheel and tire came bounding over the center median and
struck the plaintiff's vehicle at the driver's side crushing the plaintiff's left hand.

Injuries

The plaintiff has undergone eight surgeries due to the injury to his left hand. His hand remains deformed and claw like and he has lost over 70 percent functional use of his left hand. The plaintiff is virtually incapable of performing any activities that require the use of two hands, and also has difficulty with the most basic tasks including dressing himself. The plaintiff has also suffered profound psychological trauma as a result of the injuries that he sustained. He has been diagnosed with chronic post-traumatic stress disorder as well as severe major depressive disorder and, from a psychiatric point of view, he is totally disabled.
