Facts
In September of 1990, Plaintiff was a commissioned salesman in a business brokerage. Defendant retained Plaintiff and Plaintiff's employer to sell its business. Plaintiff was terminated, by the broker, during the listing agreement. The agreement was terminated by the seller, but Defendant seller sold its business during the extension time and refused to pay the commission to the broker.
