Plaintiff Mary Hawkins was hospitalized at defendant Vernon Convalescent Hospital after suffering a massive stroke. The plaintiff was 88 years old and had paralysis, an inability to swallow, a urinary tract infection, peripheral vascular disease and weight loss. The plaintiff was totally dependent on the defendant's staff to meet her needs. The plaintiff stayed at the defendant's facility for three months. When she was admitted, she had hardness and redness in certain parts of her skin. Those areas developed into bed sores. One of the wounds became infected and required the plaintiff to be transferred to another hospital. After the plaintiff returned home, she sued the defendant for fraud, negligence and abuse.
