On April 7, 2001, at approximately 9:30 a.m., the defendant was traveling eastbound on the 210 Freeway. She transitioned to the southbound State Route 2. It had been raining. The vehicle in front of the defendant's vehicle stopped. The defendant began to change lanes and lost control of her vehicle. Her vehicle collided with a light pole and then went over the side of the freeway. According to the plaintiff, the defendant was in the far left lane of the transition road and the plaintiff was in the far right lane. When the pole fell, the plaintiff was unable to avoid running over the end of the light fixture. The plaintiff claimed that after she ran over the light fixture, her car spun around 360 degrees. After she composed herself, she called 911 which was already aware of the accident. She then proceeded to the next exit, two miles away. She was having car trouble so she called her boyfriend's brother, who had been driving in the vehicle in front of the defendant. He met her at the exit. He checked her car and then drove back up to the scene of the accident in the car.

Settlement Discussions

Pre-trial, the plaintiff claimed $15,000, and $50,000 at trial. The defendant offered $4,500 pre-trial and nil dollars at trial.

Injuries

The plaintiff claimed that as a result of the accident, she sustained injuries to her neck, back, legs, knees and feet, as well as emotional distress. Defense counsel stated that the plaintiff became pregnant two months after the accident.
