Facts

The defendant Fladeboe Volkswagen Inc. (Fladeboe VW) operated an unauthorized, illegal Isuzu dealership even though Fladeboe VW lacked a dealer agreement with Isuzu and a license from the Department of Motor Vehicles to sell Isuzu vehicles. Fladeboe VW sold Isuzu vehicles to the public and serviced Isuzu vehicles. Isuzu filed a complaint against Fladeboe VW in federal court, alleging trademark infringement, tradename infringement, false advertising, unfair competition and fraud.

Result

The jury found in favor of Isuzu on all claims and awarded Isuzu $375,000 in damages. The jury also found that Fladeboe VW intentionally infringed on the Isuzu trademark.
