Facts
On August 18, 1992, the Cypress Police Department received a "shots fired" call. While investigating that call and Defendant officers Matthew Robinson, Michael Munoz, and Steven Fyhrie were approached by a woman who reported a disturbance in her backyard between her father and a neighbor. Plaintiff Alfonso Sanchez, a 45-year-old construction laborer, was standing on top of a wooden shed when Defendants arrived; he was allegedly intoxicated and in possession of a long pipe or spear-like instrument. Defendant officers persuaded Sanchez to get down and go to the front of the yard. Sanchez opened the front door of his residence and was met by Defendant Sergeant Michael Idom and Defendant officers. Sanchez refused Defendants' requests to come outside. He did, however, invite Defendants inside. Sanchez was then told he was under arrest; he resisted and allegedly struck one Defendant officer in the eye. Defendants placed Sanchez in custody by use of impact weapons and approved control holds.
