On October 31, 1991, Plaintiff, a 41-year-old medical worker, was driving her 1978 Fleetwood Cadillac southbound on the Harbor Freeway at 2:15 p.m. when she was involved in a chain-reaction rear end collision. She was stopped in traffic in the number one (fast) lane. A delivery truck owned by one Defendant and operated by another Defendant in the course and scope of his employment with the third Defendant automobile salvage company, struck the last vehicle in a stopped line of 5 vehicles. Defendant driver stated that he had just entered a freeway onramp and traveled across the other lanes of traffic when he struck the fifth vehicle in a line of stopped automobiles, while traveling 45 mph. Plaintiff's Cadillac was the second vehicle in the line of five. Defendants did not dispute liability.
Settlement Discussions
The Court contends that the Plaintiff demanded $45,000 new money and Defendants offered $20,990 new money. (Defendants had already advanced $6,463 for medical bills.)
