Facts
On October 13, 1988, a small shopping center in Sacramento burned down as the result of an electrical malfunction. Defendant John Shelton, the owner of Defendant J&W Auto Parts, allegedly spliced around a light fixture in the southwest corner of his shop. He had been having problems getting the other lights to work as a result of that light fixture malfunction. Plaintiff Goldies Bookstore, Inc., sued Defendants for loss of profits.

Defendants contend they made no offers. Plaintiff contends they made a 998 demand for $311,000.
Damages
Defendant contends Plaintiff claimed $2,300,000 in lost profits. Plaintiff contends damages claimed ranged between $700,000 and $2,300,000 depending on the loss period of 5-20 years.

Parties stipulated to an 11 person jury after an alternate and one juror became ill.
