Facts
On January 21, 1990, Plaintiff, a 42-year-old machine operator, was in the course and scope of his employment and was operating an alleged power press that formed plastic bottles in which various liquid sediments were placed. The machine originally came with a complete interlock guarding system that protected the user from the reciprocal die device. Defendant employer allegedly removed that guard; Plaintiff caught his right hand in the die. The machine manufacturer was also named as a Defendant.
Settlement Discussions
