On Aug. 11, 1990, the plaintiff, went to the defendant's restaurant in the evening to purchase food and beverages. There were people loitering in the rear parking lot of the premises who were not patrons of the defendant restaurant. As the plaintiff was walking through the parking lot, a group of persons engaged in a fight with a couple that attempted to flee to avoid injury. In an attempt to flee the parking area, a motorist struck the plaintiff with her automobile, then backed up over the plaintiff, rolling her tires over the plaintiff's leg, causing injuries to the plaintiff's legs and back. The plaintiff brought this action against the defendants based on negligence and premises liability theories of recovery.

The plaintiff made a settlement demand for $150,000. The defendants made a settlement offer of $20,000 (per the plaintiff).
