Grace Hechanova was hired by Gateways Hospital and Mental Health Center as a case aide and was transferred to the position of licensed vocational nurse in order to oversee a medication room. After working for Gateways for nine weeks, her employment was terminated. Hechanova filed suit against Gateways.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged wrongful termination in violation of public policy, unlawful retaliation, and intentional infliction of emotional distress. Plaintiff alleged that she complained about sexual harassment on behalf of a residential manager, which caused her termination.
DEFENDANT'S CONTENTIONS:
Defendant argued that the termination was lawful in that Plaintiff had poor performance, failed to follow directions, acted insubordinately, and was generally hostile toward her supervisors. Further, Defendant denied the allegations, and argued that Plaintiff made up the allegations.
Damages
Plaintiff sought $500,000 for emotional distress and three years' salary.
Result
The jury found in favor of the defense.
