Facts

Plaintiff, a 45-year-old laborer, was cleaning out a vacant airplane hanger which was inhabited by pigeons and, as part of the process, had to sweep and remove pigeon droppings. Consequently Plaintiff contacted cryptococal meningitis which didn't show up for a number of months. In September of 1989, Plaintiff presented to Defendant hospital with complaints of prior spells of vomiting and dizziness; the Defendant's emergency room staff instructed her to come back later, if she didn't feel better. Ultimately the infection went to her eyes and caused blindness.
