Facts
On May 22, 1992, Plaintiff Jane Doe, a 19-year-old student, was found in the boys' locker room of a high school, with Defendant John Roe, a 22-year-old student. Both were naked from the waist down; both are mentally challenged and dependent adults; both denied having sex at the time. Both were suspended pending parental conferences. Plaintiff later alleged that she had been raped by Defendant Roe and that both the school officials and the alleged rapist terrorized her not to report the incident.
